OUR CONTRACT WITH YOU:

If you purchase a product or products for yourself or on behalf of a company or another entity, you enter into a contract with Valpys. It is, therefore, important that you read the information relating to the product and/or service carefully.

In line with the Fair-Trading Ordinance 2023 Valpys is committed to selling goods and providing services to a satisfactory quality, fit for purpose and as described.

YOUR RIGHT TO CANCEL:

If purchasing a product or products through the website, or if you are ordering via distance means, you can change your mind and cancel the contract within 14 days of either the date of your purchase of the product or products or from the date of delivery of the product or products. You do not have the right to cancel if you purchased your product or products in the shop.

To exercise your right to cancel, you must inform us of your decision to cancel the contract by telephoning us on 01481 238422.

To qualify for a refund or an exchange, the product or products, must be returned complete with any box, packaging, instructions (including handbook) and any accessories and MUST be in a new, saleable condition. For clarity, any products that have been used or damaged (including packaging) will not qualify for a refund or an exchange.

If you cannot return the product or products to us, we can arrange a collection from your property which will incur a collection charge which we will agree with you in advance of any collection.

If you paid for your product using a credit/debit card, we will refund you on the credit/direct debit card used to pay for the product. If you paid by cheque or bank transfer, then we will refund you via an online payment method. Please note that, due to bank charges, there is a cancellation charge of £5.00.

Refunds will be paid within 14 days of cancellation date.

MAKING A PURCHASE:

We are under a legal duty to supply products that conform with the contract. We will take every reasonable step to provide full product information with regard to make, model and cost and any additional charges including delivery instructions.

If purchasing through the website, we will try and display as accurately as possible the colours, appearance and details in the images that appear on the website. It is important to note that products may vary slightly from those images.

Natural products may show some colour variation. As permitted by law, we accept no liability associated with such variations.

If purchasing a product which is on display in the shop, it is important to check the product for any signs of obvious damage or defect. You will be deemed to have accepted the product as seen.

If you have ordered a product according to measurements that you have provided, please ensure these measurements are correct and accurate. Your right to return will not be available unless the products are faulty or damaged.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on our website and in the shop are clear and accurate. If this information is provided to us either directly or indirectly by manufacturers or suppliers, it may change without notice. Whilst we take every care to monitor this data, this is out of our control.

PRICE AND DELIVERIES:

Prices:

Prices for products includes free standard delivery. However, they exclude installation charges. Installations are carried out by our own dedicated Delivery and Installation Engineers. For a full list of delivery charges please refer to the delivery charges page on the website.

From time to time, we may apply discounts and/or offers to products on the website and in store. Details of all offers will be clearly displayed on both the website and in store. Please note we may apply discounts and/or offers at any time and without notice.

Deliveries:

When your product or products are in stock, we will arrange the earliest opportunity to deliver, this is subject to other deliveries already booked in the diary. We are unable to deliver at a specific time but can allocate either a morning (AM) or an afternoon (PM) delivery. Our Delivery and Installation Engineers can call you up to half an hour before making the delivery if you are not at home.

Once booked in the diary you must do all you reasonably can to enable the delivery to take place on the given date, as arranged. If the product or products cannot be delivered as a result of you not being home, and without access to the delivery location, then an additional charge will be incurred. Please refer to the list of delivery charges on the website.

Prior to requesting delivery of your product or products, it is your responsibility to check that it will fit into your property and can be safely and securely taken from the delivery vehicle to the site of installation. With that in mind, we require knowledge of the following: –

  • If you have steps or stairs
  • If you have narrow hallways, doors or cupboards
  • If you are having a tumble dryer stacked on a washing machine, or are replacing a washing machine with a tumble dryer on top
  • Any other special instructions including:
    • Parking & Access
    • Pets
    • Appliance Door Hinges
    • Vent Hoses & Extension Cables
    • Appliance located on a raised unit/shelf

All connections are to existing supplies only. Cupboards should all be clear to get to the water supply. The cost of any sundry items required such as hoses, junction boxes, additional cabling etc are chargeable to the customer.

You should also take time to read the handbook supplied with your product.

Please note that, in the interests of Health and Safety, our Delivery and Installation Engineers have the right to refuse an installation. In this case, you should expect to receive a refund on your installation charge within 14 days of installation date.

Should you have any concerns with the installation of a product then this should be reported within 48 hours (or next business day) after which, Valpys cannot be held responsible for any subsequent leak/s or installation issues.

PAYMENT:

Payment can be made by cash, cheque, most major credit or debit cards and by online payment methods.

If purchasing a product or products on behalf of a business a purchase order (PO number) might be required before processing your order. In addition, where you are a business, you are responsible for all orders placed by your employees on your behalf.

We must receive full payment for your product or products before delivery. This may or may not include a charge for installation and removal of an old appliance.

AVAILABILITY:

All products are subject to availability. If you order a product or products which are not available from stock, we will take every reasonable step to contact you to discuss how you wish to proceed. Availability is subject to the availability of the product or products from the supplier and carriage to Guernsey which will be outside of our control. Whilst we will make every effort to ensure that you are informed of any delays, we cannot be held responsible for delays in our receipt of the product or products and it being available for you. Once your product or products arrive in stock, we will contact you at our earliest opportunity to arrange for your product to be delivered or collected.

We are pleased to assist you in sourcing and choosing the product that you require. If it is a product that we do not usually stock, it will be treated as a special order. Special orders can be placed by emailing sales@valpys.gg or contacting the office on 01481 238422 or in person at the shop. It is your responsibility to check that the specifications and measurements of the product that you are ordering meets your requirements and expectations. If the product does not meet your requirements, there may only be a limited refund available to you.

As soon as your product or products is in stock, we will arrange the earliest opportunity to deliver, this is subject to other deliveries already booked in the diary.

AFTERSALES AND FAULTY PRODUCTS:

On receipt of the product or products, you must check they match your order and meet your requirements. If you detect a problem with your product or products you must contact us immediately using the contact details above. If there is a problem with your order or your product or products are faulty then do not use them.

If you are not satisfied that your product or products are not of a satisfactory quality/fit for purpose; you have the right reject within 30 days from the date of which you acquired the product or products.

Depending on the issue we will look to resolve your problem by one of the following remedies: –

  • Arranging for our Delivery and Installation Engineers to check the installation and ensure that everything has been installed correctly.
  • Arranging for our Domestic Appliance Engineers to diagnose and repair the product to meet your requirements.
  • Offering an exchange, price reduction or refund and removal as appropriate.

Please note, the right to reject within 30 days excludes product or products that have been damaged and/or interfered with either deliberately or negligently by you or any person related or connected to you.

Your product or products is also likely to be covered by a parts and labour warranty. You are directed to read and understand the terms and conditions of your warranty which can be found in the owner’s manual.

OUR RIGHT TO END THE CONTRACT:

We can end the contract with you upon giving at least seven working days’ written notice except in the case of an emergency where we will not be required to give you any prior notice for the following reasons: –

  • You do not comply with the 2023 Ordinance and these Terms and Conditions.
  • You fail to pay for all charges due from you in relation to the product or products or service.
  • You have, or any person related or connected to you or acting on your behalf or with your knowledge has either deliberately or negligently removed, damaged, stolen, lost or interfered with and failed to keep in safe and good condition any product or products purchased from us.
  • There are health and safety reasons including an emergency.
  • Upon our ending of the contract, any money due to us in respect of the contact which has ended shall become immediately due and payable.

COMPLAINTS:

We are committed to providing excellent customer service. If you are not satisfied with your product or products or the service, you have received then you can make a complaint via the following channels: –

Before making a complaint, please check to ensure you have the following: –

  • A summary of your complaint with as much detail as possible including dates of purchase/service.
  • Name, supply address and job number/invoice number (if known).
  • Your preferred method of us contacting you regarding this complaint.

Investigation – We will look to resolve your complaint as quickly as possible. If your complaint is more complex and involves further investigation, we will explain why it is likely to take longer and provide updates along the way.

Resolution – On conclusion of our investigation, we will send you a response via your preferred contact method. As part of our complaints’ procedure, we look to review processes and learn from outcomes.

Escalation – If following investigation, you are still not satisfied then you have the right to escalate your complaint to the Guernsey Trading Standards Service.

DATA PROTECTION:

In the course of our dealings with you, and to perform our obligations under the contract, we will collect and process personal information about you. This information will be collected and processed only for the purpose of our contract with you. It will be stored accurately and as a record of when you have purchased a product or products together with dates of when your product or products have required repair. This is all required to ensure cover under your manufacturer’s warranty.
